"With precautionary order no. 321/2020, published today, on Administrative Court of the Marche it pronounced rejecting the precautionary petition integrated in administrative appeal no. RG 402/2020, presented once again by the animal rights association Lega Abolizione della Caccia (LAC) for cancellation after suspension of the Hunting Calendar 2020-2021, approved by the Marche Region with DGRN 1060/2020 ". This is what the regional hunting associations say in a joint statement, Libera Caccia, Arci Caccia, Enalcaccia, and Federcaccia, formed in court against the animal rights appeal.
"The TAR Marche, fully acknowledging the exceptions of the hunting representatives - reads the press release -, considered that the precautionary conditions feared by the environmental association as the basis of the application for suspension, noting preliminarily the non-existence of the fumus bonis iuris (the appearance of a good right in the appeal) even before the danger in mora, that is, the possibility that the contested provision may cause irreparable damage to the protected interest ".
He then continues: "In fact, the Board of the TAR highlighted how"the complaints formulated in the appeal appear at first easy to be unfounded ... ", considering that" the Marche Region "in the preparation of the Hunting Calendar" has substantially respected the rationale of the contested rules ", finally, noting how the national opinions expressed by ISPRA are derogable in the exercise of the regional administrative power in faunal - hunting matters ". The regular continuity and good functioning of the hunting faunal sector was guaranteed - they conclude - which would otherwise have risked being completely paralyzed by yet another ideological attack, aimed at unjustly compressing the collective interests underlying the hunting associations that took part in court.
