The evolution of the story
The request arises from the latest development in the matter, following the appeal filed by the Earth Association on August 12, in which the President of the 2nd Section of the Regional Administrative Court (TAR) issued a single-judge decree, inaudita altera parte, suspending wood pigeon hunting for September 2, scheduling a preliminary hearing for the same day. Federcaccia Calabria was the first, and with timely intervention through its legal team composed of Attorney Biagio Di Vece, assisted by Attorney Domenico Furfaro, appeared in court on August 13 to defend Calabrian hunters, raising procedural challenges that were acknowledged by the President of the 2nd Section of the Regional Administrative Court (TAR). Among other things, he ordered the appellant to immediately notify all parties present of the granted order, reserving further decisions regarding Federcaccia's disputes at the hearing on the 2nd.
The sentence of the Council of State
Meanwhile, the Council of State has issued a ruling amending the Marche Regional Administrative Court's ruling on last year's hunting calendar, issued on an appeal filed by Federcaccia, represented by attorney Alberto Bruni. The favorable ruling represents a particularly significant landmark in the matter in question, establishing and consolidating principles that must be respected. It once again established that the Regions may deviate from ISPRA's opinions, providing justification, and that the opinion is in no way binding. This ruling highlights and consolidates the arguments put forward by Federcaccia Calabria, with its technical and legal team, with obvious direct implications for the appeal currently pending regarding the early opening of wood pigeon hunting in Calabria.
Next developments
The appellant, Earth Association, having acknowledged the events, withdrew its request for a stay, effectively canceling the trial, which was scheduled for September 2nd. Following the withdrawal, Federcaccia Calabria promptly filed a detailed petition, requesting the Regional Administrative Court (TAR) to revoke the single-judge decision, acknowledge and close the dispute, and order Earth Association to pay costs, deeming the association's arguments unfounded. Following Federcaccia Calabria's request, the other hunting associations involved in the proceedings also submitted the same request. Federcaccia Calabria will keep its members and all enthusiasts constantly updated on the progress of the proceedings and the decisions that will be made, continuing the fight to defend the Calabrian hunting community.
