The defense of a friend
Yet another case of a hunting license denied with excessive severity and then returned after using a bit of common sense comes from Umbria. The protagonist of the story is a man who, during an illegitimate check by some hunting guards, he had simply defended and helped a hunter friend.
Illegitimate controls
The ENPA guards carried out the check: the crimes charged were those of resisting and threatening a public official, as well as the refusal to provide personal details. Based on what emerged, the friend helped was not able to keep his dogs at bay during the check, so the person whose license was then revoked reminded him of his rights and the check was carried out outside the context of the hunting activity.
The judges' motivations
According to the investigating judge of Perugia, the charges must be dismissed with the following reason: "The hunting guards are found not to be in possession of the relevant powers outside of controls during the hunting exercise, a circumstance which cannot be found in this case". The administrative judges also held that the man's behavior did not contain any conduct that "appears to be particularly serious, as well as incompatible with the safe possession of weapons".
