Heavy penalty
The case involving an Umbrian hunter and the Perugia Territorial Hunting Area 2 is truly peculiar . The ATC's Ungulate Commission fined the man, suspending him from hunting for the 2024-2025, 2025-2026, 2026-2027, and 2027-2028 seasons. The fine was then appealed, seeking its annulment or compensation for damages.
Violation of privacy
Indeed, the hunter's personal data was allegedly disclosed unlawfully, due to the disciplinary action being passed on to another ATC (without the appellant's knowledge). The Umbria Regional Administrative Court ruled in favor of the Regional Administrative Court, emphasizing this detail: "ATCs, while performing public wildlife management functions, act as private associations when they impose disciplinary sanctions on their members for violations of internal regulations."
The judges' motivations
The lack of jurisdiction has therefore been recognized, with the ordinary judge expected to hear the case. Furthermore, no damages will be awarded: "The protection of personal data falls within the scope of a non-authoritative association's activity, falling within the jurisdiction of the ordinary judge, as provided for by the Privacy Code."
