The contested behaviors
It all started with the order of the Varese public safety authority. The protagonist of the story reported a theft at home and the police contested the custody of weapons and the illegal possession of 8 antique weapons that were not registered in the collection license. The administrative judges accepted the man's appeal for "deficit of investigation" and "lack of motivation".
Nothing illegal
In practice, according to the TAR, the possession of the 8 contested weapons is not illegal since they are historical and their addition to the collection did not represent a change such as to justify the complaint. The conduct of failure to store, then, is not configurable in relation to ancient weapons. A new precedent, therefore, that enriches an already very broad and varied jurisprudence.
