La Power Police Headquarters he does not renew his license to carry firearms for hunting because he has on his shoulders a complaint for false ideology and because during two checks he is found in the company of people burdened by prejudices. But he resorts to the TAR Basilicata who gives him reason and orders the Questura to cancel the provision and to proceed with the renewal of the firearms license. This is the story that involved a man from Potenza, represented and defended by the lawyers Antonio Murano and Vincenzo Paolino. The hunter decided to challenge last September the provision of the Potenza Police Headquarters concerning the rejection of the request aimed at renewal of the license to carry a shotgun for hunting use.
A rejection that the Police Headquarters has motivated as follows: the man's complaint to the Judicial Authority for the crime of false ideology, the existence of two police checks during which the applicant was caught in the company of people burdened with prejudice and the cohabitation of man with a person burdened by impedimental prejudice. Police headquarters and the Ministry of the Interior appeared in court. The TAR, during the procedure, ordered the Ministry the filing of documented clarifications regarding the nature of the reasons adopted for the rejection of the application and in particular of the frequentations of the man with persons burdened by police prejudices.
The Tar Basilicata (president Fabio Donadono, councilor Pasquale Mastrantuono and referendum and drafter Paolo Mariano) held that the appeal deserves acceptance, as "none of the reasons underlying the contested provision is effectively capable of supporting the refusal sub iudice". Furthermore, with regard to the man's complaint, the TAR specified that there was also an dismissal by the Court of Potenza.
Compared to the other reasons that led the Police Headquarters to reject the renewal request, for the TAR the frequentation of the man with people burdened by police prejudices and with the spouse they are "marginal and irrelevant prejudices". Thus the Regional Administrative Court for Basilicata sentenced the Police Headquarters and the Ministry of the Interior to pay the litigation costs in favor of the appellant, liquidating them on a flat-rate basis in 1.500 €, as well as legal accessories and reimbursement of the unified contribution, ordering that the sentence be enforced by the administrative authority (Wave News).
