The facts examined by the TAR
The Regional Administrative Court of Umbria was called to express its opinion on the case of one hunting license withdrawn to a man for some events he was involved in about 10 years ago. What specifically happened? First of all, this person appealed against the provisions of the Prefecture of Perugia.
The appellant's behavior
Based on the reconstruction of the facts, the man was guilty of the crimes of resisting a public official, carelessly giving away weapons, failing to report a change in the place of possession of weapons and hunting on days of hunting silence. In practice, after being caught by the provincial police while he was shooting at game illuminated at night with the car's headlights, he also rammed the police car.
The judges' motivations
The appeal to the TAR of Umbria it was motivated by the fact that the case has now been closed from a criminal point of view, furthermore in the ten years that have passed the conduct of the protagonist of this affair would have been irreproachable. The administrative judges agreed with him, explaining how the dismissal is not synonymous with the unfoundedness of the facts, but at the same time these are not suitable for basing a judgment on the reliability regarding the use of weapons after such a long time.
