Hunting in Liguria. According to the observations of the Council of Ministers in the appeal against the Ligurian Regional Law n.29 / 2015, the legislation would violate in some points article 117, paragraph 2, letter s), cost. which attributes the legislative competence in the matter of "protection of the environment, ecosystem and cultural heritage" to the State.
The Regional Law in question contains in fact "first provisions for simplification and growth relating to economic development, training and work, local public transport, legal matters, culture, entertainment, tourism, health, regional strategic intervention programs ( pRIS), Construction, homeothermic protection of fauna e hunting sampling (linked to the 2016 stability law) ".
The Government pointed out that within the regional legislation there are provisions that provide for the control of hunting teams or voluntary guards to be entrusted to boars in protected areas, in urban areas and in periods of prohibition of hunting, instead of public security personnel such as provincial police officers in contrast to the national law on hunting 157/92.
The planned extension of the training period for hunting dogs in the month of August is also contested by the Council of Ministers as provided by regional law therefore not subject to a mandatory scientific opinion as is instead provided for administrative resolutions; moreover, the training of dogs in the period in question would cause a strong disturbance to wildlife and in particular to young or newborn specimens.
The appeal of the Government also disputes the contents of the Ligurian Regional Law which would approve 15 additional days of roaming hunting for those hunters who have chosen to practice exclusively hunting with fixed stalking mode with live calls, or vice versa (15 additional days of hunting from fixed stalking to those hunters who have chosen the stalking hunt as an exclusive form).
In the same way, the appeal rejects the rules that would allow the transport of weapons in the days of hunting silence (Tuesday and Friday) in order to kill previously injured roe deer or fallow deer even if traced in areas where hunting is prohibited.
The satisfaction of the environmental associations that count on the sure cancellation of the Ligurian regional law by the Constitutional Court in consideration of the negative outcome received in the past by other similar regional laws, including that of the Liguria region n.24 of 2014, has been discounted.
