New formulation
The Regional Council of Lombardy has approved by majority (43 votes in favour, 18 against) the law amending the regional hunting regulations which incorporates the provisions of the recent national law on the promotion of mountain areas, which abolished the paragraph of the national law which prohibited hunting activity on mountain passes affected by migration routes. The new formulation is therefore included in the text of Regional Law No. 26 of 1993, which also introduces the new institution of mountain passes crossed by the most important migration routes. Identified by a Decree of the Ministry of the Environment, these specific passes may be considered partially or fully protected territory following the establishment by the Region of Special Protection Areas (SPAs) within the Natura 2000 Network.
A very simple purpose
"The law approved today," explains rapporteur Floriano Massardi (Lega), "serves a very simple purpose: to align regional legislation with national legislation, thus avoiding any uncertainties regarding its application. We could have simply left it alone," Massardi continued, "since national law prevails over regional law, but in this way we are responsibly contributing to clarifying the regulatory framework, as long-awaited by operators, organizations, and associations, and in anticipation of the Lombardy Region hearing on October 9th."
Agenda rejected
The bill was signed by Councilors Floriano Massardi, Claudia Carzeri, Carlo Bravo, Marcello Ventura, Pietro Macconi, Michele Schiavi, Giacomo Zamperini, Anna Dotti, Alberto Mazzoleni, Maira Cacucci, and Silvana Snider. A motion presented by Massimo Vizzardi (Mixed Group), which sought to call for compliance with European directives, was rejected. Before the vote, Agriculture Councilor Alessandro Beduschi intervened, declaring that the implementation of European directives in Italy dates back to a decree by Minister Pecoraro Scanio. Numerous Councilors from both the minority and majority sides spoke during the debate, the former calling the law the result of forced interpretations and risking litigation, and the latter reiterating and confirming the arguments already advanced by the rapporteur.
