Precautionary order
The Council of State ruled yesterday, Wednesday 21 January 2026, on the appeal presented by the ANUU of Veneto against the precautionary order of the Regional Administrative Court which had as its object the partial annulment of the wildlife and hunting calendar.
The species concerned
As is now known, the Veneto Regional Administrative Court (TAR) granted the request of several animal-environmental associations, ordering an early ban on hunting gadwalls, common moorhens, mallard ducks, and redwings. This ruling inevitably caused quite a stir.
The reasons of the Council of State
However, the Council of State rejected and dismissed the migratory campaigners' appeal. The reasons for this were as follows: "The objections, on the one hand, can only be examined in the proper collegial phase, and, on the other hand, they are not capable, at that stage, of overturning the assessments made by the first judge in the appealed order, which suspended the hunting calendar for the four species indicated on the basis of the precautionary principle."
