The judges' choice
In the 80s, the man from Monte had accustomed people with his famous commercials to always say yes. However, the Lombardy Regional Administrative Court's decision regarding the hunting of finches and starlings in derogation, a provision that refers to the 2025-2026 season. The administrative judges have in fact upheld the animal-environmentalist appeal filed by several organizations, specifically ENPA, LAC, LAV, LIPU, LNDC, and WWF.
Hunting cannot be a habit
This is the explanation from LAC: “The Administrative Court reaffirmed a fundamental principle: hunting protected species cannot be a habit. The "derogation" provided for by the Birds Directive is an extraordinary exception that requires rigorous proof:
- Lack of alternatives – The Region has not demonstrated the absence of other satisfactory solutions before taking up arms
- Lack of motivation – The TAR emphasized that the regional resolution lacked a serious investigation, limiting itself to replicating schemes repeatedly rejected by European and national justice systems.
Institutional short circuit
The League for the Abolition of Hunting then added: “LAC, along with other associations, also denounces the intention of several regions to reopen the exemptions for the current year, despite the clarity of the courts. This represents an institutional short circuit that exposes Italy to costly European infringement procedures, paid for by the entire community.".
