The appellants
The Veneto Regional Administrative Court ruled on the appeal filed by LAC, LAV, LNDC, LIPU, and OIPA against several hunting associations and the Region regarding the challenge to hunting calendars. Specifically, the environmental and animal rights groups considered the first sentence of Article 18, paragraph 4, of Law 157 of 1992 to be unconstitutional.
The motivations
This is the passage that emphasizes that " the deadline for challenging hunting calendars is thirty days from the date of their publication in the Official Bulletin of the Region ." According to the animal-environmentalist perspective, this passage should be changed because it was intended only to make challenging the hunting calendar more difficult, given that such a time limit would not be sufficient to take legal action.
No unreasonable choices
However, the Veneto Regional Administrative Court (TAR) ruled that the appeal could not be upheld. The judges reasoned: " An expedited procedure for processing appeals against hunting calendars, and in particular, the thirty-day deadline for filing an appeal from publication in the Official Gazette of the Region, is not unreasonable, nor does it make the exercise of the right to a defense impossible or extremely difficult ."
Limited effectiveness of calendars
Even more interesting is this postscript: " The provision of a thirty-day deadline for appeal is functional to providing stability to the balance of interests at stake, taking into account the fact that the hunting calendar is effective for a limited number of months and that, with respect to the opening dates of the hunting season, the interest in the appeal decision normally ceases, for the majority of species, with the beginning of October ."
