Tuscan hunters, it is a duty and urgent to appeal against the government that closed the hunt early: stop incompetence, arrogance and illegality, guarantee certainties for the future.
The Confederation of Tuscan Hunters, to which Federcaccia, Arci Caccia and ANUU adhere, adopts the legal opinion made available by Federcaccia Nazionale and signed by all hunting associations; the opinion highlights the illegitimacy of the work of the Presidency of the Council of Ministers last January 20 with the early closure of the hunting woodcock, song thrush and cesena. The opinion has already been sent to the presidents and the competent councilors of all the regions in support of the actions that the regions themselves, it is hoped, will want to adopt. In any case, it is the firm intention of the CCT to use that opinion as the basis for any action useful to censor, before the TAR and in all appropriate fora, a behavior in which incompetence and arrogance have alternated, giving life to a shameful page for the contempt manifested by the rules, procedures, the principle of loyal cooperation between the State and the Regions and, ultimately, for the laws of the state itself.
There was no procedure by the EU against the Italian State (as falsely alleged by the Government) but only a simple request to the Italian Government for data and clarifications. Request sent by the “competent” Ministry to the regions which, moreover, promptly processed the file by providing updated data and detailed information on the problems posed. Among other things, it does not appear that the Government has sent the responses of the Regions to the EU, a further act of incomprehensible arrogance.
The regions, in respect of which the Government, with an unprecedented degree of severity, exercised the substitute power, have legitimately worked in formulating the hunting calendars, complying with what is indicated by a State law, the 157/92, punctually respecting the indications on the hunting periods allowed and remaining within the prerogatives and roles assigned. In the absence of amendments to that law by the Parliament, what appears in all its drama is the failure of the government to respect the law itself.
