Il Tuscan Regional Council approved the law proposal n ° 430 concerning the management and protection of wild fauna in the regional territory. Amendments to the regional law 12 January 1994, n. 3 (Transposition of the law 11 February 1992, n. 157 “Rules for the protection of homeothermic wildlife and for hunting”). The text, the fruit of a long consultation process, was approved with the votes of the PD group, the Northern League and Italia Viva. The votes against were those of the 5-star Movement and some Councilors belonging to the Mixed Group and the Yes-Tuscany group on the left. The new regional law on hunting and the introduction of some reform contents of the previous legislation, represent some of the fundamental points arising from the final document of the Regional Conference on hunting held in Trackers last year and strongly supported by the Councilor Marco Remaschi.
A work that has seen the Tuscan Federcaccia and the leaders of the Confederate Associations in the Confederation of Tuscan Hunters committed with seriousness in recent months and that today, delivers to Tuscan hunters a positive result and a solid regulatory reference for the coming years. Despite the continuous instrumental attacks of the animal / environmental world, the regional government forces and also part of the opposition, have been able to keep the value of politics and good administration high by putting in place choices that consolidate one of the most advanced regulatory frameworks at national level. On the merits, we want to list the main aspects that characterize the new law n ° 430 and which will need to be developed in the coming weeks, for the purpose of their timely application:
• The concept of "Wildlife Management" in addition to that of its protection;
• The principle of "Subsidiarity" on the services and activities of a procedural and assistance nature that the Region may in part delegate to hunting associations and agricultural assistance centers. The promotion of the safety culture will also be delegated to these subjects;
• The Regional Council establishes a "Scientific Committee" aimed at analyzing population dynamics for wild fauna species on the regional territory;
• A fund is set up for the support of ATC budgets, the constitution of their representative body is formalized and the procedures for the assignments, expenditure procedure, compensation for damages and presentation of financial statements are better defined;
• Reduced to 5% of the fee paid by the ATC to the Region, the funding for the functions referred to in regional law 70/19 (Provincial Police);
• Important changes are introduced for the management and perimeter of public wildlife institutes The hunting of the Fox, Magpie and Hooded Crow is allowed within the Hunting Respect Zones (ZRV).
In addition to what has been highlighted, one of the most qualifying points of the new text is that relating to the reform of Article 28 bis of Law 3/94. In the new structure, the reformulation approved definitively exceeds the limits of the old "Objective Law", giving back to the ATC the role and functions in the organization of the wild boar selection hunt and for the maintenance of the necessary balance between forms of hunting. A concept that is the basis of a precise political will; Strengthen the role and tasks of the ATCs, since these bodies today have a function of liaison with the territorial instances, resulting from the overcoming of the delegations carried out by the provinces until yesterday. Finally, but not in order of importance, the article concerning the procedures of the discipline for the hunting use of decoy birds was approved. In particular, the characteristics, validity and the procedures for ringing the calls themselves; all this will guarantee greater legal certainty for migratory hunters and for the use of live decoys.
