The decision of the judges
With ordinance n. 5685/2022 published today, the Council of State has rejected the appeal proposed by the environmental/animal rights associations for the reform of the precautionary decision of the TAR Tuscany, which had decided not to grant the suspension of the Tuscan hunting calendar 2022/23, in particular the date of 30 January for the closure of the hunt for ducks, turdids and woodcock. Federcaccia was the only hunting association to support the Tuscany Region in defending the hunting calendar and the result obtained before the Council of State is obviously of great satisfaction, for two main reasons. The first is that today's ordinance of the Council of State has also been made against the Ministry of Ecological Transition which has supported, not without surprise, the environmental / animal rights associations.

The second is that the procedural exceptions raised and discussed by Federcaccia seem to have been shared by the Council of State:
environmental/animal rights associations are not entitled to challenge those regional hunting calendars which introduce more restrictive measures than hunting and therefore prove to be more favorable for the protection of the environment;
environmental/animal rights associations cannot bring an appeal against the regional hunting calendars, limiting themselves to referring to the opinion of Ispra and the Key Concepts, having instead to take charge of specifically censoring, one by one, the reasons assumed by the Regions to deviate from them.
Strengthened by this success before the Council of State, which follows other precedents before the Regional Administrative Courts, Federcaccia will continue with even greater determination in defending the values of hunting so that, even in court, these are recognized without prejudice and in the compliance with procedural rules.
