The Regional Council of Veneto, approved with 34 votes in favor and 14 abstentions (the minority directors and FdI) the Pdl n. 140 “Amendment to the regional law 9 December 1993, n. 50 'Rules for the protection of wildlife for hunting' ". The law tries to reconcile the needs of agriculture with those of hunting. As the rapporteur pointed out, “The Veneto Region, with law no. 50 of 1993, defines the legal preconditions necessary to regulate, as part of a rational planning of the territory, hunting. It is the responsibility of the Region, in fact, to plan the hunting fauna of the whole agrosilvo-pastoral territory in full compliance with law no. 157 of 1992. This regional planning has recently found a new implementation with the wildlife hunting plan approved by the Regional Council with the regional law of 28 January 2022.
Of particular importance is the provisions ofart. 15, paragraph 7, of law no. 157/92 which, with a view to protecting agricultural activity in particular, expressly establishes: 'Hunting is in any case prohibited in a wandering form on land currently being cultivated'. In order to offer further and effective defense for farmers, their land and company assets, a specific legislative provision was introduced into regional law 50/1993, paragraph 3 bis and paragraph 3 ter of art. 27. Paragraph 3 bis establishes that "Shooting is not permitted during hunting in a stray form within vineyards and olive groves with drip irrigation systems not buried, arranged along the rows of crops, as well as shooting in the direction of the same land less than 50 meters away ", for the benefit of the so-called 'visible' irrigation systems, not buried, technically defined as 'above ground drip irrigation systems, with drip lines' installed along the rows of vineyards and olive groves.
The intent is to avoid that during the hunting activity, there may be cases of puncture of the pipes of the aforementioned irrigation systems that represent company assets due to theuse of firearms, preventing its use when you are both inside the crop under protection and outside. Paragraph 3 ter of art. 27 establishes "The prohibition referred to in paragraph 3 bis does not extend to firing with a rifle in selective sampling and to wildlife control pursuant to article 17 and does not concern land not previously delimited by tables, by the owners, according to the model and the methods of affixing defined by the regional council ".
For her part, the minority co-rapporteur explained that the desire to reconcile the needs of agriculture and hunting is positive, but we cannot ignore the need to contain the costs borne by farmers, avoiding imposing on them the obligation of signing along the perimeter of the land concerned and the replacement of one or more rows of pipes damaged by shooting. Hope to lead to 70 mt the minimum distance from which it is possible to shoot.
