A non-permanent disease
A recent ruling by Council of State turns the spotlight on a particular situation that has to do with the license to carry firearms. According to the judges, an unfitness or a temporary pathology cannot in any way represent a reason to revoke the licence. In the present case, it was an eye disease, from which the protagonist of the story is then recovered.
The verdict of the TAR
The Regional Administrative Court of Emilia Romagna had been of the same opinion, so much so as to agree with the woman - a security guard - during 2017. However, the Prefecture railed against this ruling, which did not take into account the reversibility of the pathology. The explanation is soon said: "The momentary pathology of sight would not have in fact affected the ability to keep the weapon at home".
The reassurances of the doctors
The diagnosis is dated 2015: for three months the woman would not have been able to use weapons, a period of time which then increased by another 180 days. The Council of State has brought some order after having consulted the military doctors who are treating the security guard: after the reassurances, the aforementioned sentence arrived.
