Damage from wildlife
The Court of Cassation has expressed its opinion on accidents between cars and wild boars, a sentence destined to become jurisprudence and from which the judges can be inspired in assessing similar situations. According to Piazza Cavour, in fact, the Region can be held responsible for damage to the vehicle caused by wildlife. The facts refer to what happened some time ago in Montorio al Vomano, in the province of Teramo.
The various verdicts
A car hit a wild boar along a state road, causing damage to the bodywork for around 2 thousand euros. The justice of the peace had agreed with the motorist, recognizing the Abruzzo Region and the Province of Teramo as the bodies that had to deal with the compensation. Only the Province managed to avoid payment, while the Region decided to appeal to the court, which agreed with the local authority.
Overturning of the sentence
However, the Cassation overturned the verdict again. The "stoats" were very clear from this point of view: the passive legitimation belongs exclusively to the Region which has the competences for what concerns the wildlife heritage, coordination and control. The trial papers were then sent back to the Court of L'Aquila.
