Two important rulings arrived yesterday 7 September: the TAR of Emilia Romagna rejected the request for suspension of the LAC with a motivation that is a breath of fresh air in the field of hunting law: for the Emilian Judges the ISPRA opinion it is legitimately refuted by the Region and the ISPRA Key Concepts are dubious and uncertain, given the marked discrepancy compared to other Mediterranean countries. What Federcaccia has been preaching for years we read today in a court order! The points of contact between the calendars of Emilia and Lombardy are many: even that of Emilia Romagna is much more permissive in January as well as at the opening (opening that the LAC has not even contested in Emilia, but in Lombardy yes). The allowed game bags are practically identical. The two ISPRA opinions appear to be photocopies of each other. We hope that this "turning point" of a TAR be a good omen.
The LAC was ordered to pay too 1.500 € expenses (plus VAT and various costs). Unfortunately in UMBRIA the President of the Regional Administrative Court, since the first hearing was useful on October 4, decided that he had to postpone any evaluation until then and, in the meantime, suspend the calendar. The appeal was notified on 4 September to the Region, still not defended, but as soon as it became known of the appeal and the order Federcaccia intervened in court, formally asking, as required by the code, that the President in the light of the defenses review his decree before the hearing on 4 October. In Umbria what happened in Lombardy in 2021 happened: if you delay too much to adopt the calendar it becomes impossible to examine the issues before the opening and so, as a precaution, the hunt is suspended.
Calendars must be approved by May: this is the only way to avoid surprises. And today, more or less at lunchtime, it will be the turn of LOMBARDY (March 14) Alongside the Regional Advocacy, Federcaccia with the Enalcaccia on one side and the ANUU on the other promptly intervened by depositing detailed documentation on the conservation status of the species, on the Atlas of Migrations, on the Key Concepts, entering the reality of Lombard hunting, dismantling the imaginative inferences of the LAC point by point, demonstrating the sustainability of the game bags, motivating the absence of risks of damage to the fauna, the compliance of opening and closing dates with the individual and specific indications of ISPRA and the Directives, and the serious and congruous reasons that the Region has placed at the basis of its choices (all resulting from the official documents). then the Free Hunting also intervened, which does not enter into the merits of the Lombard specific issues and characteristics, but focuses more on the general scope of the Birds Directive and the 157 / 92 law.
In the meantime, the same LAC has abandoned the surreptitious request to suspend hunting due to the heralding drought, according to him. excruciating agony of the fauna, which actually gave a damn about the fact that we could not irrigate the corn fields: after all, the wildlife had more water than is strictly necessary for its survival, also guaranteed by the regulations (in environmental matters) which protect the maintenance of mandatory minimum levels of water in rivers. But on the calendar it will be another story: we are confident that if the Judges pay attention to the precise observations made on the dates, on the species, on the game bags, on the regional motivations, then the requests from the LAC (which never supports its claims with research and data, but only paints heartbreaking and dramatic post-apocalyptic representations) can only be rejected.
But today we know: the Hunt suffers from a social perception that is certainly not positive, and we are always in danger. Through us our members will be in the classroom a make your voice heard, to defend hunting, to try to wrest our passion from the lies told by extremist animalist fringes. Certainly there will be no hunters in the classroom who do "private insurance": their "insurers" certainly will not defend their passion and they will morally stand at the bar, with the truth in their pockets, gossiping about who in the end defends them too, crossing their fingers and hoping to benefit from the work of others (Federcaccia Lombardy).
