The choices of the Ligurian judges
Whoever allows a minor to go hunting with his rifle loses the firearms license regardless of the way in which the criminal proceedings are concluded. This was established by the Regional Administrative Court of Liguria with two separate sentences (66/2023 and 67/2023) with which it rejected the appeal against the decisions of the Police Headquarters and the Prefecture.
The oblation
This is an important precedent and one that cannot be ignored in future legal discussions that will have to do with hunting licenses. In the present case, the criminal trial ended with the extinction of the crime by oblation.
The rules of administrative justice
The latter is an alternative rite to criminal judgment by which, with the payment to the State of a pre-established sum of money, a "particular" contravention crime is extinguished. Administrative justice, in fact, follows stricter rules and what happened is in itself sufficient to justify the declaration of unreliability in the use of weapons (source: ANUU).
