Pluralism and democracy
Arci Caccia continues his fight for pluralism and democracy in CTFVN. While awaiting the ruling of the TAR on the exclusion of numerous Associations from the Committee, in contrast with ln 157/92, we would like to add that: the amendment contained in ln 136/ of 9-10-23, published in the Official Journal last 09/ 10/23 which modifies the art. 11 bis of 157/92 introduces, in addition to the opinion of ISPRA on the Calendars, also that of the National Technical Faunistic Hunting Committee. We note some points that require urgent clarification, so as not to worsen the current situation, which is already extremely problematic.
The five questions
1. As the law appears to be written, the two opinions have the same "mandatory and non-binding" nature. In the event of a conflict between the two, which will prevail? Will there be more work for the courts? Let's hope not, there's enough uncertainty already.
2. It is taken for granted that all Regions issue calendars no later than June 15th, in reality we know that not all, indeed perhaps only a minority, respect this deadline. How can the time needed for the start of the hunting season be guaranteed, having to wait and evaluate a further opinion?
3. What behavior should the representatives of the Regions within the Committee adopt when expressing their opinion on documents issued by the bodies that appointed them, so as not to make the opinion open to attack?
4. In addition to these purely technical issues, which will need to be clarified before next spring, we would also like to underline a political issue. Why did Parliament, and the majority in particular, want to enormously strengthen the role of ISPRA with respect to hunting calendars? In fact, the Institute, in addition to the usual independent opinion, will also express itself within the wildlife technical committee. What will the results be?
5. We must acknowledge that, in meetings with various government representatives, we had recorded and discussed exactly opposite intentions. What has changed?
