The appeal to the TAR
Arci Caccia took the field with its legal staff against the decision of the Abruzzo region to change the criteria for allocating posts in the ATC Management Committees. A penalizing decision, aimed at excluding our association from participating and not only that, to benefit another. An act that is absolutely at odds with the ideals of the Association which, as President Maffei has repeatedly stated, "will fight to the end to guarantee pluralism and the participation of hunters, at a national level as well as in the territories". For this reason, an appeal was filed before the TAR of Abruzzo, with the hunting association receiving the explanation of its lawyer, the lawyer Matteo Valente.
The explanation of the lawyer
Here's what he said about it: "The question appears simple, the Abruzzo Region has approved a resolution aimed at modifying the criterion for assigning the posts due to the AAVV in the ATC management committees. This is not only in contrast with the Abruzzo regional law on hunting, which sets different criteria. In fact, the law provides that the six representatives of the hunting world are divided among the nationally recognized associations present in the area, provided that they exceed 1/15 of the hunters present in the province. Now, the modification changes the cards on the table, assigning representation with the so-called d'hondt method, a method of calculation that is inapplicable in matters of this type".

Valente added: “As a precautionary measure, we have asked for the suspension of the provisions challenged with the appeal, with a consequent re-examination of the procedure for appointing the Management Committees of the Territorial Hunting Areas indicated therein. On the merits, the acceptance of the appeal and the annulment of the contested provisions, if necessary subject to disapplication of the illegitimate regulatory provision” (source: Arci Caccia).
