A substantial sentence
The TAR of Reggio Calabria with a substantial and exhaustive sentence, expressed itself favourably on the appeal initially proposed by the Hunting Associations ANUU MIGATORISTI, ARCICACCIA, ENALCACCIA and EPS, to which subsequently, driven by a common feeling, LIBERA CACCIA and ITALCACCIA were also added. The appeal sponsored by the lawyer Emiliano Pezzani saw the annulment of the Decree of appointment of the Metrocity signed by the former Acting Mayor Avv. Carmelo Versace, of the members of the Management Committees of the ATC RC1 and RC2. This ruling crushes the expectations of Federcaccia, which through Metrocity had benefited, without blushing, from three additional places in both ATCs, taking them away illegitimately from other recognized hunting associations, as the TAR ruling has clearly demonstrated, blatantly betraying the constitutional principle of participatory pluralism.
The rejection of administrative judges
It must also be said that Federcaccia in this context had also constituted itself as an opponent against the appellant associations, but it too was soundly rejected by the TAR. Obviously, this conduct has also produced a deep rift between the latter and the other Calabrian hunting associations that in unison stigmatize this unfair, arrogant and unscrupulous behavior. That the Decree of appointment was wrong in form and substance, tainted by a brainless investigation and a delirious interpretation, had been pointed out, in due time, by the excluded hunting associations in a special meeting with the Councilor delegated to Hunting Dr. Salvatore Fuda and the lawyer Carmelo Versace, who, although informed in detail of the errors committed in drafting the Decree, did not consider us worthy of any response, highlighting a singular way of interpreting the role of public administrator.
Appointment of management committees
But sooner or later the knots come to a head, and the answer came anyway, the Tar Calabria thought about it by definitively ruling on the appeal, accepting it in its entirety and annulling the Decree of the Metropolitan Mayor of Reggio Calabria n. 17 of 21/09/2023, for the appointment of the Management Committees. It should be added that the two administrators, Fuda and Versace, had made a decision on the appointments, diametrically opposed to that which the Mayor Avv. Giuseppe Falcomatà had made at the penultimate renewal of the bodies, who had correctly attributed a place to each recognized hunting association, as provided for by the Regional Law on Hunting and which in the meantime has never changed, applying the principle of representativeness in compliance with participatory pluralism. So the same Law, two absolutely different interpretations, everything that happened during the period of absence of Mayor Falcomatà is absolutely inadmissible.
Very serious problems for hunting
Now, in compliance with the provisions of the sentence, we expect the establishment of the two new Management Committees in a short time, given that those illegitimately constituted can no longer proceed. This in a period in which the hunting planet is going through very serious problems, first of all the PSA and the wild boar emergency, and we can no longer afford seasons of commissioners, such as the last one that lasted about two years, and that one day science will tell us why, right Dr. Salvatore Fuda? We also take note that your inadequacy for the role assigned to you with the delegation on hunting is so palpable for us that we hope for a decisive and dignified step back (ANUUMigratoristi-Arci Caccia-Enalcaccia-EPS-Italcaccia-Libera Caccia).
