Just 24 hours later, Sicily has provided the second consecutive set of the most interesting rulings regarding gun permits and ammunition possession. After the case of a hunter who regained his license after being denied it due to relatives with criminal records , this time it was the turn of a man convicted of failing to pay support to his ex-wife and young children. The Agrigento Prefecture issued the ban, which was later overturned by the Regional Administrative Court of Sicily on the following grounds: there is no evidence linking the alleged behavior to firearms misuse.
Defense challenge
The Prefecture's ban dates back to 2024. The man's defense's objection is simple: the refusal was reached by merely accepting the Carabinieri's proposal and without delving into his personality and the disputed facts. It's worth noting that the failure to pay child support resulted in his probation to social services. The administrative judges started precisely from this latter premise.
What will the Prefecture do now?
According to the Regional Administrative Court of Sicily, the man's conviction is not one that automatically carries a ban on weapons and ammunition. The Prefecture would also have had to explain why the man was considered unreliable in this regard due to his failure to pay child support. The appeal was therefore upheld by the Regional Administrative Court, which consequently overturned the ban, although the Prefecture itself may now review the case.
