In the Council meeting of 11 May in Lombardy region Three amendments to the 26 / 93 law.
1) First of all it is clarified that the authorizations of the stalking have a duration of 10 hunting seasons from issue, and therefore there will be no risk of having to suspend the hunting activity during the season for possible renewals. This is certainly an excellent simplification.
2) Furthermore, the possibility of taking over is definitively clarified new owner different from the heir in the authorization of stalking in the event of the death of the holder: this puts an end to the interpretations of individual Territorial Offices, which are reluctant to apply the rule.
3) Lastly, in the matter of wildlife planning, a change was introduced for which the regional wildlife plan rather than having expressly "Five-year duration", once approved, it can “be updated at least every five years”.
The new rule is in fact aligned with the national law, which provides that the Regions make "any" changes or revisions to their plans every five years. It is now clear that the Regional Plan may have a duration of more than 5 years (and fortunately, given the time needed to approve it), but in any case the Region will have to "at least" every 5 years (and therefore even earlier, but certainly not beyond 5 years) verify its adequacy and thus provide for its full confirmation or its modification or its adaptation to the supervening conditions, or its reconstruction when it will be considered completely obsolete or no longer complies with the law.
But at least every five years it will be necessary to verify the adequacy of the plan, with the adoption of any necessary corrections: after all, the regional regulation it can only be interpreted in the light of the national provision, and so it would obviously be interpreted by the Administrative Judges, as indeed a few days ago demonstrated by the Council of State. On the other hand, if we wanted to understand the five-year period as the minimum term of the plan untouchability and not also as the maximum term (as it is for national law), the norm should have been set differently.
