Sardinia: EU rejected the law-derogation for the hunting of cormorants created to protect Sardinian fishermen.
New rejection of the EU Court of Justice against Italy on the hunting regulation front, this time for a law enacted by the Sardinia Region. The European judges accepted the appeal with which the European Commission asked for the Italian government to be condemned for violating the EU law that protects all species of wild birds.
In particular, the rule by which the Sardinia Region authorized exceptions to the wild bird protection regime, not respecting the conditions established by the relative directive (79/409 / Cee), had ended in the sights of Brussels.
An exemption on the basis of which the go-ahead was given to the culling of a certain number of cormorants in February 2009, to avoid damage to fish production.
In the authorization provision, there is no trace of the extent of the damage or of the search for alternative solutions. While an exception - observes the EU Court - should be granted only in the event that there is no other solution.
