We cannot fail to intervene on this unlikely affair which cannot end with a few articles in the newspaper and go into oblivion. There Federcaccia of San Miniato to which it is important not only the defense of the rights of the hunting world, but also the environment and the territory in general, reaffirms the need to implement all the necessary steps with the utmost urgency so that this type of abuse is definitively pursued and avoided. We share and support the Mayor's indignant statements, inviting him to proceed with the means permitted in order to clarify and set a strong example for good management. We urge it, also through the support, therefore to the constitution we have requested several times, of the Council, made up of the Associations of Truffle Hunters and Farmers, so that the monitoring of the territory becomes a good management tool and important reference for the Municipal Administration of San Miniato.
We invite the Mayor to convene us to proceed with the review of the Rural Police Regulations, which do not mention, for example, safeguard of the Cypress, but partial reference is made to certain plants, Article 19 of the same Regulation. We turn to Enel as Manager and responsible for the maintenance of power lines, which has allowed companies to carry out radical interventions contravening the provisions of the Forestry Regulations of Tuscany, as stated in Section II - Protection of forest plants not included in the woods, Art. 55 - Scope and Art. 56. We invite the Municipality (and Enel SpA) to consult the decision of the Court of Tempio Pausania in a recent sentence no. 294 of 17.03.2017 on a similar case.
Moreover, the same law imposes on the Operator of the electricity network some precautions which, in the specific case, Enel has not respected at all: in fact, it has carried out the culls without requiring the cooperation of the owner of the trees who could have recommended a less harmful cut. He did not take into account that, in the hypothesis of an area with those characteristics of artistic and environmental interest, such a deep and invasive cut was not necessary: the risk of malfunctions and interferences could have been reduced in any case with a more limited and careful work on the protection of trees of considerable naturalistic and landscape interest. Having highlighted the above, we point out that this type of intervention, although necessary, is often carried out without a minimum operational criterion and without having respect for the environment, history, culture of a community, of a country in fact losing that slightest hint of the sense of responsibility in acting.
The municipal area is crossed by numerous power lines, many of which overlook woods. In our hunting activity, we constantly come across environmental-naturalist havoc of killing all types of plants, in particular along the power lines, where they are left in place in the form of shapeless and dangerous mounts of shrubs, potential vectors of fires, once dried. The havoc is magnified when we consider the waste of wood perpetrated. We invite the Mayor to legally prosecute those who have infringed the principles of law governing these interventions. Above all we want to pay the attention of the Mayor and the owner, to verify where the plants have been brought, since from our inspection, there is no trace of them anymore. The economic value of Cypress plants is well known. Therefore and with these premises, it becomes even more indispensable and we urge the Mayor to convene and establish, with the extremely urgent, the Council which, given the increasingly frequent events in our territory, becomes an indispensable tool (Source: Federcaccia of San Miniato).
