The Regional Administrative Court for Umbria (First Section) ruled that the case was partly inadmissible (as regards the early opening of the turtle dove hunt) and for the rest rejected the request for annulment of the Regional hunting calendar 2024-2025 and the related resolutions proposed by LIPU, WWF, ENPA and the National League for the Defense of the Dog, against the Umbria Region and the Territorial Hunting Area ATC Perugia 1 and which also saw the intervention ad opponendum of the Italian National Hunting Federation and Federcaccia Umbra. From reading the Sentence issued today following the Council Chamber of last September 24, two passages emerge and are of absolute importance with which the TAR motivates its decision.
Key concepts
The first is that appeals against hunting calendars cannot simply limit themselves to recalling the opinion of ISPRA, which is questionable, but must contain specific criticisms regarding all the reasons assumed by the Region. With the second, it has finally been recognized that the Italian KC 2021 are not legally binding and the investigative elements assumed by ISPRA to render its opinions can be overcome by the Region by referring to other more recent sources of scientific information and to the data that constitute citizen science, among which are also included what is produced through the work carried out by the Studies and Research Office of Federcaccia. “I can only applaud the good result reported before the TAR of Umbria. Once again, and not only in this season and related round of appeals and decisions of the Administrative Courts, more than one court has recognized the well-founded power of the Regions to detach themselves from what are only opinions of ISPRA and the validity of the results coming from the studies and research carried out with ever greater commitment by our Office" commented the National President of the Italian Hunting Federation Massimo Buconi.
Underrated commitment
