"The sentence issued by Tar of the Eagle about the hunting calendar is not acceptable by the Italian Federation of Hunting. Unfortunately, with regret, we must note that the judges described as old the data of the 2009-2018 census of water birds in Italy, which are instead the most recent available, having been published in 2021, while those of the Hunting Wildlife Plan date back to 2014. Evidently the judges have not investigated which data are more recent, thus issuing a sentence perhaps a little too hasty and certainly not in line with what the judges themselves should have verified.
The Tar Abruzzo has provided for a ban on hunting at the mouths of rivers declaring that the Abruzzo Region would not have established the protection zones along the migration routes, while the Abruzzo Region has as many as 26 Nature Reserves, 59 Natura 2000 sites, 5 Protection Oases, 3 National Parks, 1 Regional Park, 57 repopulation areas and capture and other different forms of territorial protection that lead to a percentage of protected territory greater than 60%. We ask ourselves, at this point, on what basis and on what information the TAR issued this sentence.
If the judges had resorted to jurisprudence, they would also have ascertained that their colleagues at the Sicilian regional administrative court established that the oasis of protection and ZPS they constitute the protection zones along the migration routes. Also in this case the decisions of the Tar L'Aquila appear very superficial. We hope that at the time of the judgment on the merits the judges will evaluate the established provisions with the due certainty of the laws and regulations. Ultimately, in fact, I want to underline a further mistake that in our opinion the robots have committed by issuing a hasty sentence and on certainly incorrect bases. The judges of the Tar have in fact ignored that the new Wildlife Hunting Plan does not provide for a ban on hunting at the mouths of rivers. Thinking badly makes you sin, but sometimes you get it right, someone said and our recurring thought is that the judges have cited the Wildlife plan only when hunters were to be penalized.
We believe that the time has come that we do not operate in one direction, often wrong, against hunting regardless. We remember that hunters are useful for the defense of the territory, the protection of the undergrowth, a correct use of nature.
