Judgment of the TAR
With regard to the decree of the TAR Calabria published yesterday, following the umpteenth appeal by animal-environmentalist associations, it is necessary to provide clarity: the provision rejects the request to suspend the effects of the press release of the Calabria Region of 10.01.2025 which announced that, following the amendment of art. 18, L. 157/1992, the hunting of Turdidae could continue until 30 January 2025. No dispositive value should be recognized instead in the motivational passage contained in said decree which provides a restrictive interpretation, which is not shared, regarding the application of article 18, paragraph 4 of law 157/92 as amended by the latest Budget Law.
Withdrawal Methods
In fact, the new paragraphs 1 and 4 of art. 18, Law no. 157/92 state that until the sentence that defines the judgement (which is not that of the TAR which has been appealed before the Council of State which will decide on 29 April), hunting activity is authorised and legitimised by law and no longer by the hunting calendar and, for the purposes of the methods of collection (bag, days and times of hunting), the activity is regulated by the last valid calendar, which in the case of Calabria, since the times and number of animals that can be harvested are not contested, the current 2024/25 season can be considered. Therefore, contrary to what environmentalist-animalist associations want to argue, in Calabria, the new measures of the financial law are applied, precisely by virtue of the decree of the president of the TAR Calabria who rejected the request for suspension of the press release of the Calabria Region 10.01.2025 which retains the power/duty to once again redetermine the closure of the hunting of Turdidae.
The next Council Chamber
Federcaccia Calabria, convinced of the arguments above, has constituted itself in the trial proposed to the TAR Calabria by the environmentalist-animalist associations and, after having obtained the rejection of the request for suspension, will participate in the next Council Chamber on February 19 to forcefully support its theses. The news has just come out that some hunters yesterday afternoon were sanctioned for having hunted Thrushes on the note of the Carabinieri Forestali who recorded that the decree of the President of the TAR n. 42 of 23.01.2025 would have even modified art. 18, L. 157/1992 currently in force. Any comment on this is superfluous and, in reiterating that we will provide the widest legal assistance to the sanctioned hunters, Federcaccia will evaluate all the most appropriate actions to protect the entire category of Calabrian hunters.
The precaution to use
Finally, given the confusion created following yesterday's decree by the President of the TAR, Federcaccia invites THE CALABRIA REGION to clarify and, in the exercise of its powers, confirm the closure of the hunting of Thrushes on January 30, 2025. Until such confirmation, or in the absence of DIFFERENT institutional determinations, Federcaccia invites only as a mere "precaution" the Calabrian hunters to refrain from continuing the hunting of Thrushes (source: FEDERCACCIA CALABRIA).
