On May 18, 2022, the Piedmont Regional Administrative Court issued a judgment that was nothing short of historic (JUDGMENT OF THE PIEDMONT TAR 18 May 2022) which definitively annulled the illegitimate Mayor of Graglia last October 29, 2021, (GRAGLIA ORDER 29 October 2021) giving back to the hunters those venable territories that the aforementioned trade union measure denied, in short, it is possible to hunt in the areas adjacent to the primary school of Graglia, always respecting the distances from the buildings as foreseen the strict regulations of the hunting law (nr 157/92)
Right from the start we hunters and professionals understood that the aforementioned ordinance was "phony", without any legitimacy and was only an act of arrogance towards the hunting world.
The Piedmont Regional Administrative Court already on 15 December (TAR PIEDMONT ORDER 15 December 2021) partially accepted the appeal presented by ATC-CA Biella 1, indicating that provisionally the ordinance issued by the first citizen of Gragliese continued to have effect only on weekdays, liberalizing hunting again on holidays, specifying that the final decision would be issued on May 18, 2022.
It happens to everyone to win and lose and I am firmly convinced that losing hurts and above all causes severe burning in the august behind, but I never expected to read a series of utterances by the Mayor of Graglia without meaning and above all without validity as reported in the 'article published by the bi-weekly "The new Province of Biella" of 11 June (11 JUNE 2022 THE NEW PROVINCE).
For clarity, it is right to give some answers to the statements read in the newspaper quoted above:
It is not true that he did not hunt for the whole school year, as from 19 September 2021 to 29 October 2021 (date of the issue of the trade union ordinance of denial) the hunters were able to hunt easily every day allowed by the calendar. hunting as then from 15 December 2021 until 18 May 2022 where it was possible to hunt on holidays.
I read of a certain optimism about the future possibility of not being able to hunt, as desired by the mayor of Gragliese, I would really be curious to know on the basis of which legislation, given that his order was canceled, and that the aforementioned national law 157 / 92 expects to be able to carry out hunting activities.
I love to point out with serious and credible arguments, the sentence of the Piedmont TAR as already widely written was issued on May 18, 2022, the primary and secondary school closed on June 8, 2022, if we then take into account the end-of-year exams at all. today there will still be life inside the school, so to say that the sentence was passed on the last day of school is to all intents and purposes nonsense.
We are clear and sincere, the trade union ordinance has no basis as demonstrated by the provision of the Piedmont Regional Administrative Court.
Making false accusations then risks having to pay the consequences, it is false and tendentious to declare that the hunters shoot a few meters from the school, moreover I would be curious to know if the Mayor made this statement as he was present during the hunting trips, or she says it "by hearsay" and if she really had been present I wonder why she did not involve the police, the only figures reputed to control and possibly sanction improper behavior.
And I invite the Mayor to put his heart in peace, the fact that the sentence must be sent to the Piedmont Region, is normal as the body that owns the hunting management, as regards the compensated expenses alas it is a bad habit that almost in all cases it is adopted when the local authority is unsuccessful.
Having said and done all this, I reiterate what has always been expressed, we are thrilled that in the face of some report or problem, all to be verified, this ordinance has been issued, we had been summoned, we would have found a solution by mutual agreement without wasting public money on lawyers and Court. In fact, we are only talking about a couple of hectares of land. But we do not accept the bullying and the attempt to publicize the reputation of the hunters.
A special thanks is due to the Monteleone e Siletti law firm in the persons of Avv. Stefano Monteleone and Luca Siletti, who studied, evaluated and drafted the document that led us to this historic victory.
