In fact, it is clear that in the event that live decoys are found which are suspected of being "unauthorised" according to national or regional provisions, the operators of SOARDA (anti-poaching and animal crime operations section) do not apply the special rule envisaged (article 31 , paragraph 1, letter h), of law no. 157) according to which the "administrative sanction from 300.000 to 1.800.000 lire must be applied for those who make use of unauthorized recalls, or in violation of the provisions issued by the regions pursuant to article 5, paragraph 1", but proceed to the formulation of crime news pursuant to art. 30, paragraph 1, letter. h), which however does not concern the use of unauthorized live decoys, but only the use of prohibited decoys (as identified by art. 21 paragraph 1, letter r), which prohibits "using birds for decoy purposes alive blinded or mutilated or tied by the wings and acoustic calls with mechanical, electromagnetic or electromechanical operation, with or without sound amplification").
Abuse of power and oppression
It also appears that the same operators contest the counterfeiting of public seals pursuant to art. 468 of the penal code referring to the identification rings of live decoys coming from breeding, issued by private associations, in the case of mere suspicion that the "seal", although original and not counterfeit (and despite not being a seal of a public office or a public body) has been affixed with mechanical alteration of the dimensions; For some time, hunting associations have denounced abuses of power and oppression by some zoophile guards in the hunting sector who operate beyond their competences and ownership, violating the rights of hunters during their hunting activity. The questioner has received reports from hunting associations regarding the questionable methods with which the SOARDA carabinieri have in some cases carried out control and surveillance operations against numerous hunters in the exercise of hunting activities in compliance with current regulations , forcing some hunters in the province of Brescia to file a complaint.
The role of environmentalists
It is also known to the questioner that the same associations denounce the fact that SOARDA operators often carry out the checks in groups of 6-8 agents also accompanied by volunteers from environmental associations, therefore making a disproportionate use of means and personnel to carry out the checks. controls. The questioner has also received reports regarding the participation, despite not having the right, of operators of environmental associations without any of the qualifications provided for by the art. 27 of law no. 157 of 1992, and in some cases coming from foreign countries, to the inspection, search and seizure of live decoys, subsequently taken to the area's CRAS (game recovery centres) managed by environmentalist associations, which even in the face of a release order coming from the Prosecutor's Office, were never returned, in violation of the custody obligations established by the penal code. We ask to know whether the Ministers in question are aware of the facts presented and what actions they intend to take, each within their own sphere of competence, so that in the fight against poaching, compliance with the law by only those authorized to do so is guaranteed, as well as the rights of the subjects in the exercise of the hunting activity and in order to carry out a verification throughout the national territory on the methods of carrying out the voluntary activity by the aforementioned associations."
