Hunting for thrushes
The failure to validate the criminal seizure against the hunters to whom - as is known to all Calabrian enthusiasts – last Thursday afternoon the practice of hunting thrushes was contested and even more so the content of the related decree of the Public Prosecutor's Office of Crotone, confirm once again what Federcaccia Calabria has repeatedly reiterated regarding the correct applicability of the new rule introduced with the Budget Law amending Article 18 of Law 157/92 also in our Region. Federcaccia has immediately and repeatedly emphasized how the ruling of the TAR Calabria could not be considered an autonomous source of legislation even if the Council of State had denied the precautionary suspension of its effects, leaving it up to the Region, in compliance with the principle of separation of powers, to re-determine the closing date of hunting thrushes with its own specific provision.

Of the same tenor is the decree of non-validation of the seizure with which it was established by the Public Prosecutor's Office of Crotone that the hunters unjustly sanctioned did not commit any crime, ordering the release and immediate return of the hunting vehicles. Federcaccia, which without delay provided immediate and full legal assistance to the innocent protagonists of the surreal affair, cannot but express satisfaction for its outcome. and thank once again its legal team in the persons of the lawyers Alberto Bruni and Biagio Di Vece, who with the briefs produced contributed to the achievement of this positive result.
Incident to be clarified
In light of a necessary precautionary principle, despite the well-founded certainty of its reasons, in the immediacy of the news of the incident and the findings contested by the Carabinieri Forestali, Federcaccia Calabria had advised hunters to refrain from hunting thrushes, repeatedly urging the Region to intervene to clarify the matter. But in light of the reasons for the subsequent decree with which the Public Prosecutor's Office of Crotone did not detect the existence of the contested crime and taking into account that the Calabria Region has not taken measures contrary to its official communication published on the Agroservizi portal last January 10, the effects of which therefore remain valid since the President of the TAR Calabria rejected the request for suspension advanced by the environmentalist/animalist associations, it remains confirmed that hunting thrushes can continue until Thursday January 30.
