Special Protection Areas
The Chamber approved the amendment to Bill No. 2126 – Provisions for the recognition and promotion of mountain areas, which establishes that the mountain passes crossed by the migratory routes of avifauna - characterized by a difference in altitude ≥ 1 m - can be delimited as Special Protection Areas (SPA) from the adoption of the ministerial decree. At the same time, the possibility of carrying out hunting activities is foreseen within the limits and under the conditions established by the Regions, as already effective for the 000/2023 hunting season, and permanent from the entry into force of the decree. The path will be implemented thanks to the agreement between the Ministry of the Environment, MASAF, the State-Regions-Provinces Conference, and the CTFVN.
Traditional hunting practices
This rule also responds to the outcome of the Lombardy Regional Administrative Court ruling no. 1516 of 2 May 2025, which required the Region to immediately ban hunting on 475 mountain passes, with a 1 km buffer, in implementation of resolution XII/854 of 20 May 2025. This had interrupted hunting activity, creating uncertainty between the territories of Lombardy and Brescia, so much so as to push the Lombardy Region to challenge the decision before the Council of State. For Lombardy, and in particular for the territory of Brescia, the amendment represents a balanced response between the need for environmental protection - established by regional administrative jurisprudence - and the recognition of traditional hunting practices, fundamental for local communities.
A clearer picture
Thanks to this regulatory framework, clarity is immediately guaranteed on:
How many border crossings are affected, according to the 1 km buffer from the TAR delineation;
The operating conditions agreed between Ministries, Regions and CTFVN;
Regulatory continuity, avoiding interruptions during the hunting season.
For territories such as Valle Trompia and the Brescia Prealps area, already involved in institutional discussions and hearings, the amendment is a fundamental step to redeem the critical issues reported after the regional deliberation and to guarantee at the same time sustainable management of the territory (Hon.
