The Italian legislator has always been concerned with a particularly important issue: the keeping and custody of weapons. The art. 20 of Law 110/75 states that "the custody of weapons must be ensured with all diligence in the interest of public safety".
This wording, to be honest a bit cryptic, has led in recent years to a series of doubts about what the legal obligations are. In particular, attention was focused on whether or not it is compulsory to have an armored cabinet. A ruling by the Court of Cassation should have made it clear that the law does not impose the obligation to keep weapons in armored cabinets, prescribing that every precaution must be taken in order to prevent unauthorized persons from coming into possession of the weapons.
We have deliberately used a verb in the conditional "should" because even today many Carabinieri stations or police offices claim that the weapons are kept in armored cabinets. Since the matter is extremely delicate and that the law penalizes anyone who neglects to take the necessary precautions in the custody of weapons to prevent unauthorized persons from easily getting hold of them, our warm suggestion is in any case to have an armored cabinet. .
Let's see in detail for what reasons: first of all, as we said previously, it is the law that requires us to be particularly careful and although it does not oblige us to use the armored cabinet, it tends to severely punish behaviors that can generate doubts or interpretations. In other words, it is you who must prove that in the absence of the armored cabinet you have ensured beyond any reasonable doubt every diligence in keeping and preventing unauthorized persons from coming into possession of the weapons.
