The Fourth Section of the Regional Administrative Court of Sicily expressed itself on the appeal filed by a man against the failure to issue a license for hunting rifle use by the Catania Police Headquarters. The no was motivated by the fact that this person lives close to their parents: the applicant's father was convicted for extortion in 1995 and for aggravated theft and private violence two years later.
The Commissioner, in particular, noted that the hunter's parents' building and that of the latter are located in a single private square. The appeal was motivated by the absence of precedents for what concerns the man and a conduct of life that has been defined as "very mirror". However, the Sicilian TAR rejected this appeal, supporting the thesis of the Police Headquarters.
Specifically, it is not a question of assessing any abuses, but the risk that the affected father goes to his son's building and can enter in contact with his weapons. The Administration has a very wide discretion in situations like this and according to the administrative judges the behavior of the Catania Quaestor was correct.
