Last Friday, December 6, the Council of State ruled following the appeal of the anti-hunting associations against the sentences of the TAR Lombardia and Emilia Romagna in relation to the annulment of the resolutions of the respective councils on the regional hunting calendars 2024/2025". The Council of State, ruling definitively, considered that it did not have to accept the request for suspension of the appellants.
AB – Agrivenatoria Biodiversitalia, had already instructed its lawyers to appear in the first instance of the trial with an intervention act ad opponendum against the appeal presented by the environmental associations on hunting calendars (in Lombardy, Emilia and other regions), in particular with regard to the references to art. 9 of the Constitution. The same has been done in front of the Council of State, where AB's lawyers, together with those of a part of the hunting associations, defended the hunting calendars, demonstrating that hunting is fully compatible with the constitutional dictate.
The President of AB, Agrivenatoria Biodiversitalia, Nicholas Sacchetti, speaking on the subject, declared “The pronouncement of the Council of State represents a historical precedent and clearly demonstrates how the principle of balancing the different interests at stake, including hunting and wildlife management, is of fundamental importance when discussing the legal position of animals. Article 9 paragraph 3 of the Constitution, amended by constitutional law 1 of 2022” – continued the President of AB – “immediately attracted the attention of animal rights groups who wanted to read it as an opportunity to close the hunting in Italy. A biased view, due to purely ideological positions. The success obtained by AB in front of the Council of State confirms that hunting activity in Italy is guaranteed unequivocally, within the limits established by European, national and regional regulations”.
AB will continue in the near future to work to protect wildlife and hunting companies in the appropriate venues, making use of the best experts and collaborating with other associations to strengthen the role of the hunter and prevent his rights from being violated.
This success comes from afar, from a work in synergy with UNA Foundation, which materialized in an important conference last July at Palazzo Rospigliosi in the presence of institutions, associations, parliamentarians and the best constitutional experts, who dictated the line on the issue of animal rights and the compatibility of hunting with the new wording of art. 9 of the Constitution. AB will continue its work of dissemination on these issues, also in light of the recent pronouncements of the Council of State, through the imminent distribution of the proceedings of the July conference to the institutions and professionals competent in the field.
