Hunting and Fauna: Marche, motorist runs over a wild boar, Parco del Conero sentenced to pay the damages suffered.
A motorist from Ancona hit a wild boar on November 25, 2010, while traveling in his own car in a straight stretch along the Conero provincial road, at the height of the Vedova. The hoofed one suddenly emerged from the vegetation and crossed the roadway just as the car arrived, which in fact could not avoid it. Following the accident, the driver was slightly injured but the car was severely damaged by the impact. Today, after more than two years, with an innovative sentence in Ancona, the Conero Park has been sentenced to compensate the damage suffered by the motorist for crossing a wild boar as the body responsible for the road. For the first time, with its own sentence, the Justice of the Peace of Ancona agreed with the motorist whose defense lawyer based the case on the lack of special deterrent devices for wildlife as barriers and reflectors that could have prevented the event by referring to a specific sentence of the Supreme Court which had established that the Authority responsible for the road affected by the presence of wildlife must always adopt specific devices, such as reflectors, capable of emitting a disturbing light when illuminated by the headlights of a vehicle. A light that is not tolerated by wild boars, for example, which are therefore forced to move away. In some mountain areas in Italy, where they have already been used, it has even emerged that the animals have abandoned the area, depopulating it. The same ruling also established the use of barriers such as fences and wooden fences to limit the passage of wild animals on the road.
The Justice of the Peace decided to agree with the motorist precisely why the Conero Park is lacking in the provision of suitable measures to prevent the crossing of fauna. Both national and regional laws, as well as regulations, attribute to the park authorities the burden of setting up suitable systems within the territories assigned to them to limit the risk of wildlife crossing the roadways. The victims of accidents caused by wildlife, especially wild boars, along the Conero provincial road are numerous and directly proportional to the greater proliferation of these animals.
