29 August 2011 - A few days before the start of the hunting season, the hunters' association expresses all its discontent. Libera Caccia makes a complaint to the Province to find out if in the extension of the provincial hunting calendar, according to the law, there have been abuses and escapes. Today the reply of the provincial administration.
According to Libera Caccia: “The calendar is unprecedented and like Libera Caccia, even though we are also signatories of a common document together with the other Tuscan Hunting Associations, it is not possible to ignore and not take protest initiatives”. "The Free Hunt, an Association that still has the courage to call itself" hunting "has decided to present as quickly as possible a complaint-complaint to the Public Prosecutor of Arezzo, to find out whether in the extension of the Hunting Calendar provincial, according to the law there have been abuses, escapes and limitations that in addition to having nothing scientific, are in blatant contrast with the dictates of the Tuscany Region ”.
Libercaccia's accusations read: "The Arezzo hunting calendar this year is filled with limitations and absurdities so blatant that it is not only extremely penalizing for local hunters but becomes dangerous as a precedent: a domino effect could be unleashed following which every The province of Tuscany in the future could venture into limitations of any kind causing a regulatory Far West from which all Tuscan hunters would come out with broken bones ".
“To give one day of pre-opening - he continues - to start thrush cesena, lark and woodcock from October 8st, eliminating garganey and fighter from the huntable species definitively are real donkey nonsense behind the blackboard. The extension of the use of steel shot in marsh stalking outside the SPAs and the closure of the pheasant female hunt after XNUMX December speak volumes about a clear persecutory will towards hunting in general.
And even if, thanks to an Institute that responds to the name of ISPRA and the restrictive data it provides, completely different from the rest of Europe, Arezzo first of the class in Tuscany closes the woodcock hunt on January 15th, the "pearl" it is represented by the prohibition of the use of the hunting dog in January, a true "artistic creation" of sublime minds who lodge in the palaces of the Province or representatives of associations-hunting in the Consulta who at least should resign immediately ".
And again, "a Province can intervene on the Regional Hunting Calendar in a restrictive sense, but it must motivate it with serious specific environmental conditions, otherwise someone will have to explain to us what the Regional Hunting Calendar is for, the result of consultations, meetings, debates at all levels that last months, if then a Province like this, in a totally extemporaneous way acts on its own? "
The provincial administration for its part replied, pointing out first of all that what is happening on the calendar, unlike what was said by Libera Caccia, in Arezzo has precedents.
Some examples: the reduction of the times of the female pheasant, requested by hunters, approved and in force for six years already; the ban on the use of lead shot in lakes already in force throughout the province of Florence since 2009; a pre-opening day, for which not only Arezzo but six Tuscan provinces will do so on September 1st, if the Tuscany Region decides; for the ban on garganey and fighter, the law provides for limitations to species in difficulty, and the data of the killing that prove it are those of the regional cards compiled by hunters; the restriction on 15st October to thrush, cesena and lark, on which the ISPRA guidelines on hunting calendars are clear on the need to postpone the start of hunting to 2009st October; the limitation to the use of dogs in the month of January, on which the law establishes that the Provinces can implement it starting from January 2010st; the closure of the woodcock on January 31, which has already been in force since XNUMX-XNUMX, while the Puglia region and the Provinces of the Marche, Emilia Romagna and Piedmont close the woodcock hunt even on December XNUMX.
Therefore, once the full validity and legitimacy of the hunting calendar has been reaffirmed, the campaign launched against the Province is surprising, with unfounded arguments, for rules already in force in some cases for years in Arezzo, Florence, Grosseto and Siena, Perugia, Bologna, Parma , Reggio Emilia, or elsewhere in Italy, without ever having been asked for an explanation.
The Province presses: "It should be added that" Liberacaccia "participated - or rather participated until today - in the Council of hunting, and its provincial representatives have never expressed the disputes that the regional presidency is making today: these gentlemen are responsible for responding and explaining the consistency of their attitude.
Regional "Liberacaccia", which invokes the uniqueness of the regional calendar, has realized that ten out of ten Tuscan provinces have each set different dates and different methods for wild boar hunting and that only the Province of Arezzo has set the period 18 September - January 31, as per regional law, while all the other provinces have changed the date of the regional calendar by reducing it? Furthermore, we cannot fail to underline that a few weeks ago the civil and correct confrontation was abandoned, to choose the path of gratuitous or scandalous controversy. If "Liberacaccia" had valid reasons, he could have recourse to the TAR, which is the competent court in matters of administrative acts ".
"Denouncing the Province to the Public Prosecutor's Office for imaginary abuses can serve to create the case, the scandal, and win some newspaper headlines, but it does nothing in favor of a serious and correct discussion on hunting, nor does it favor a correct relationship between institutions and category representatives. A few weeks ago, on the website of a hunting magazine, insults against the Province appeared, which forced them to file a complaint for aggravated slander and defamation against the director responsible for the publication and the person responsible for the offenses, not being able to allow the right to criticism goes to the level of slander.
Sorry to note that the path taken by "Liberacaccia" is the same and follows these footsteps, because one thing is the right to criticize, another thing the offenses, gratuitous and defamatory, that the press release contains. For this reason, the trusted lawyer was given a mandate to present a complaint against the regional President of "Liberacaccia" and anyone who participated in the press release with him. the slander., which led to a complaint to the Public Prosecutor's Office of Arezzo, which will assess whether these statements contain slander and defamation of the Province ”.
