Hunting in Friuli Venezia Giulia. The dispute between the Region, TAR FVG and the League for the Abolition of Hunting (LAC) on the suspension of the Hunting season which will therefore close regularly on January 31, 2016.
"Two weeks after the end of the season, the Council of State also recognizes the correctness of our administrative action in substance", comments the regional councilor for hunting Paolo Panontin. “Without taking anything away from the legitimate forms of aversion to hunting of LAC, I am satisfied because we have been able to successfully reaffirm the legitimacy and correctness of my work and my direction ”, said Panontin.
The Council of State accepted the appeal, motivating that "the suspension of the effectiveness of the contested policy act seems to create a regulatory vacuum contrary to the public interest underlying the regulation of hunting".
Summarizing the process, in July 2015 the Regional Council approved the Regional Wildlife Plan, which has been awaited for over twenty years. To make it effectively operational, however, it was necessary that, in cascade, the individual district hunting plans were also approved. As there was not enough time, for the 2015-2016 hunting season the regional administration had decided to extend the management acts in force on a transitional basis.
The LAC had intervened on this choice, denouncing the illegitimacy of the Council's resolution and asking to stop the hunting activity. The TAR of the FVG had suspended the resolution of the Executive as a precaution, reserving the right to express itself on the merits in a hearing set just in April 2016 (after the hunting season ended), effectively generating that regulatory vacuum that the Region wanted to avoid with the its resolution and which the Council of State confirmed in its ruling in favor of the Region.
