The Regional Administrative Court for the Emilia Romagna (Second Section) issued the order on the appeal brought by League for the Abolition of Hunting (Lac), WWF, Lipu, Lav which asked for the suspension of the regional hunting calendar. The reasons of the Regional Administrative Court should be highlighted, which after having deemed the objection of inadmissibility unfounded "for failure to notify at least one counterparty, given that the hunting calendar is a general administrative act, so that no counter-interested parties whose participation is necessary for the trial are identified "and subjecting to WIN as "already expressed for the Regional Wildlife-Hunting Plan 2018-2023", enters into the merits of the deviations from the opinion ISPRA regarding the closing date of the hunting season for some species of migratory birds.
The TAR in fact underlined that "the same data taken into consideration by ISPRA (KCs data 2021) are not completely peaceful, in light of the lack of consistency of the data provided by the individual States, with particular reference to those who insist on the Mediterranean basin'and that ISPRA is a "non-binding opinion from which the Region has departed with articulated technical / discretionary motivation".
In addition to this, the "feared danger - in any case completely generically envisaged in the appeal without taking into account the different species indicated in the provision whose suspension is requested - however, it is not current, being related to the closing date of the calendar in January 2023 postponed, for 2 species, by about ten days with respect to the ISPRA opinion in compliance with the deadline of the end of January indicated in the ln 157/1992". Furthermore, the TAR condemned the applicants "at the expense of this phase"Not even applying the almost usual formula of compensation of the same (source: Hunting Federation).
