Calendar suspension
Yesterday evening the Regional Administrative Court of Veneto rejected the request for monocratic precautionary measures, i.e. the suspension of the hunting calendar requested by the LAC, setting the collegial discussion in the council chamber for next October 19th.
Time span
The judges referred to the time period between the publication of the contested act (16/08/2023) and the notification of the appeal under examination here (18/09/2023), in relation to the pre-opening date of the hunt set by the Veneto Region (17/09/2023).
Precautionary measures
In addition, the request for general suspension of the contested resolution was considered, in the part in which it brought forward the opening of the hunt to 17 September 2023 compared to the date of 1 October 2023 indicated by ISPRA, in relation to some species, in opinion given on the regional hunting calendar and constituting annex a) to the contested resolution. Finally, for the TAR the conditions established by the aforementioned Article 56 of the Code of Criminal Procedure for the granting of precautionary measures in the absence of cross-examination between the parties do not exist.
