The motivations
Following the hearing held on 4 December last, with Sentence no. 39 of 07/01/2025, the TAR Sicily - Palermo, Section III, definitively rejected the appeal of the Environmental Associations declaring it partly inadmissible, and rejecting the remaining part. The Panel, with the reasons given in support of the aforementioned Sentence, reiterated the principle according to which the Opinion issued by ISPRA is “mandatory but not binding”, specifying that “the determinations taken differently from the ISPRA opinion, therefore, may be considered legitimate if they are supported by scientific studies with objective value”.
FIDC's contribution
In relation to this specific circumstance, FIdC Sicilia wishes to highlight the fundamental role of the Office of Wildlife and Agro-environmental Studies and Research of Federcaccia, which, thanks to a team of experts, has provided the regional offices with specific technical support to counter the now "obsolete" arguments with which they claim to oppose hunting activity.
Hopes for the future
Great satisfaction was expressed by the lawyers of the FIdC, the lawyers Accursio Gagliano and Accursio Augello, regarding the decision adopted by the TAR Sicily-Palermo in relation to the CV 2024/2025. Given that the provisions regarding the hunting calendar for the current year leave us with good hope for a regular performance of the subsequent hunting years, also in light of the legislative changes.
