The president of Cga (Administrative Justice Council), Rosanna De Nictolis, issued decree 335/2022 with which she rejected the appeal of the hunting associations against the order of the Tar which, on July 25, had suspended the early opening of the hunting in Sicily, authorized by hunting calendar 2022-2023, issued by the Regional Department of Agriculture. The Cga also confirmed the ban on hunting turtledove and wild rabbit, species at risk due to excessive hunting pressure. To announce the decision "With great satisfaction", the associations Enpa, Lac, Legambiente Sicilia, Lndc Animal Protection, Lipu and Wwf Italia who had challenged the hunting calendar to the TAR, denouncing its illegitimacy for violation of national and community regulations on the protection of fauna and for failure to comply with the scientific opinion of the Higher Institute for Environmental Protection and Research (Ispra).
Now even the Cga, "with words that leave no room for interpretation and that will make jurisprudence", confirmed the decision of the TAR that he had already suspended the calendar “Precisely in the most impacting and negative parts for the conservation of wild populations”, both those object of hunting and those protected but in any case at indirect risk. Not only that, the Administrative Justice Council recalled “how in past years the calendar has already been censored several times by the judges for the repeated provisions that illegitimately increased the times, methods and species that can be hunted, without the Region having taken them into account ”, underline the associations.
Thus the Cga considered the suspension of the TAR "correct and acceptable" "having regard to the supreme precautionary principle in environmental matters, the legal value of the opinion of Ispra, to the previous hunting calendars of the Sicilian Region and related litigation "highlighting precisely the" legal value "of these previous pronouncements" on the faunal-hunting calendars of previous years, which should have the value of guiding and guiding administrative action in order to ensure a correct balance between the wildlife protection, which constitutes heritage not only of the Sicilian Region but of the entire country, and the protection of the interests of hunters ".
