Hunting: Lombardy, captures live calls, for the Lombardy Regional Administrative Court the Government deed is useless as it cancels a regional deed already ineffective.
The Lombardy Regional Administrative Court, with order of 11.03.2014 on the appeal proposed by the hunting associations Federcaccia and ANUU Migrationists, both at national and regional level, against the resolution of the Presidency of the Council of Ministers to cancel the Lombardy DGR n. X / 1985 of 20.06.2014 for the refueling of live calls as well as against all the acts preceding or consequent to this decision, such as the warning of the Minister of the Regions (29.10.2014) and the opinions of the ISPRA of 29.07 and 12.09.2014, after having considered its jurisdiction and competence, it has precisely listed all eight reasons for the appeal, concluding that the regional resolution had operational validity until 31 December. The issue, therefore, did not take on any relevance because the provision of the Prime Minister, challenged by the two associations mentioned, had annulled a regional act that "HAD exhausted its effectiveness as of 31 December 2014", for which it appeared useless to the TAR granting of the suspension. This ruling is therefore directed to the Government, which annulled a regional provision which, practically, by the date of the notification of the annulment (22.12.2014) had already exhausted its effects.
The TAR, therefore, while not accepting the request for suspension (since the validity period of the regional resolution had in any case expired on 31 December), remarked in fact that the government cancellation took place when the deed had already exhausted the its effects. In other words, the Region (unfortunately incomprehensibly absent from the discussion before the TAR), may well take the decision to activate the capture plants for the next season, once the opinion of ISPRA has been acquired (even if negative, given the lightning-fast conversion of this institute to the unjustified prohibitionist line).
The hunting associations Federcaccia and ANUU Migrationists, who have always protected the legitimate interests of their members and of those who work in the sector in all their offices in a concrete and timely manner, were represented by the lawyers prof. Claudio Chiola of Rome, as well as Innocenzo and Mario Gorlani of Brescia.
