More than a year after the precautionary suspension, the TAR of Parma expressed its judgment on the Provincial Plan for the control of the Fox in the province of Reggio Emila, giving reason to the recurrent animal rights acronyms according to which the document was illegitimate because it did not provide for the use of alternative ecological remedies to hunting.
In the sentence of the TAR filed on 5 November last, the judges observed, "From the examination of the case documents it emerges that, as already held in the precautionary stage, neither the contested provision nor the related opinion of ISPRA dwell in any way on any possibility of using ecological means of control of the considered species or on the reasons for the impracticability of said alternative means. The detected lack of motivation is sufficient reason to order the annulment of the contested act ".
The defensive reasons presented in the proceeding by the Province of Reggio Emilia according to which the contested act had to be considered in the context of similar interventions carried out since 2003 and which had made it possible to reduce the problems caused by an excessive and uncontrolled growth of a species are also vain. unfortunately harmful to the fauna and biodiversity. According to the Tar judges, the considerations made in court by the Province have no juridical relevance.
