The President ofArci Regional hunting of the Marche, Gabriele Sperandio, clarified the use of radio equipment. Some hunters make use, during hunting, of radio equipment (LPD - PMR - CB) to communicate with each other. The use of some devices (PMR - CB) is subject to the payment of the annual fee of € 12,00 at the same time as the presentation of the declaration of possession referred to in art. 145 of Legislative Decree 259/2003 to be presented to Ministry of Economic Development - Marche Territorial Inspectorate (Piazza XXI V Maggio, 2 - 60124 Ancona –AN-). The declaration of possession must be submitted by registered letter with return receipt to be sent to the Ministry indicated above, accompanied by proof of payment of the annual fee of € 12,00 to be paid to the postal cc n. 145607 payable to: Treasury Prov. le dello Stato - Section of Ancona - Reason: Contribution CB - Radio amateurs - cap. 2569/06 chapter XVIII.
This payment can also be made by bank transfer with the same heading and reason on the IBAN account: IT97 R076 0102 6000 0000 0145 607. The declaration required by art. 145, paragraph 3, of the Electronic Communications Code, accompanied by the prescribed attachments indicated in the application itself, must be sent once and kept in a copy accompanied by the receipt of the registered letter and the payment of € 12,00 and may be presented in any time of the year. For the years following the first, the continuation of the authorization will take effect with the simple payment of the contribution of € 12,00 by January 31 of each year (for payments after January 31st, the fee must be increased by 0,50% for each month or fraction of a month of delay and, after December 31st without having made the payment, the communication lapses).
It should be noted that LPD devices (frequency 433.070 / 433.550 MHz) such as the ALAN 507, do not require any communication for their use. PMR devices (frequency 446 MHz) such as Midland G7 and G9, and the CB equipment, for their use, they require the presentation of the declaration to be presented in the manner indicated above. It is also specified that for the use of VHF and UHF equipment it is necessary to be in possession of the general authorization referred to in art. 104 c1 lett. c of Legislative Decree 259/2003 and amateur radio license. SANCTIONS: - For the use of the PMR and CB devices without the required communication, there is no penalty, but only reporting to the Ministry of Economic Development - Marche Territorial Inspectorate for non-payment of the annual contribution. - The sanction pursuant to art. 102 c. 2 of D.Lgs 259 / 2003 (pecuniary sanction from € 300,00 to € 3.000,00).
