Hunting: Umbria, the TAR Umbria suspends the pre-opening days for the Marzaiola species scheduled for 1 and 7 September 2014, accepting the petitioners' appeal as a precautionary measure.
"With precautionary decree no. 106 of 25 August 2014, the Umbria TAR suspended the pre-opening of the garganey hunting on 1 and 7 September, on appeal by the Victims of the Hunt Association, presented by the lawyer Massimo Rizzato from Vicenza ". This is what the association underlines in a note.
“In fact, the following considerations were recognized - continues the text released by the Victims of the Hunt Association -: violation of art. 18 second paragraph L.157 / 92 and violation of art. 32 LR 1494, Excess of power due to lack of motivation. In other words, for the failure to comply with the provisions of the aforementioned law in relation to the "environmental situations of the various territorial realities", but also in the absence of an adequate Hunting Wildlife Plan ".
"Neither of the two conditions appears to be satisfied by the Region - continues the association's note -: for the Marzaiola in fact, caution should be maximum because conservation is threatened, Ispra indicates that the gargane is 'in decline (spec 3)' and that 'an anticipation of the opening of the hunt in early September would however entail the risk of culling of the subjects that have reproduced locally, introducing a possible limiting factor for a phenomenon of natural colonization which must instead be supported'. The Region has adopted its own Hunting Wildlife Plan - with a five-year expiry - with a resolution of the Regional Council of 2179 and therefore the same was valid until the last hunting season 201314 ".
"Too many regions - adds the Association Victims of hunting - that do not update their Wildlife Hunting Plans, however, issuing all sorts of acts and regulations aimed at promoting hunting pressure on the territory, without taking into account the changed environmental and faunal conditions but also urban and anthropic. In fact, it should be remembered that the Hunting Wildlife Plans represent, in summary, the planning of the whole national territory for the purpose of exploiting wildlife resources, carried out by the region, which identifies specific areas without, too often, taking into account urban settlements, scattered houses, roadways etc.
This planning then gives rise to deeds and authorizations of local authorities (provinces and ATC - territorial hunting areas) which in fact authorize types of hunting incompatible with human presence and in clear contrast with the provisions of Article 21, paragraph 1, lett. .a), e) and f) of law 157/92 on safety distances, based on the range of the weapons used ".
