Hunting: Valle d'Aosta, the Regional Council has approved a bill that modifies the rules on hunting activities; custody of hunting dogs and huntable species.
On March 19, the Regional Council presented to the Council a draft law aimed at modifying the rules for the protection and management of wild fauna and for the discipline of hunting contained in laws 64/1994 and n. 16/2012. The provision is made up of eight articles aimed at modifying some provisions, in the parts concerning the list of huntable species, the possibility of sanctioning those who will lack the custody of hunting dogs, the establishment of a disciplinary commission at the Regional Committee for the Hunting Management which will have the task of evaluating any ban on issuing the regional hunting card.
The raven, the starling and the jackdaw have been eliminated from the list of huntable species; according to the proposers, the intent of the modification is to harmonize the regional legislation with the national one.

REPORT
This bill consists of 8 articles.
Article 1 contains amendments to Article 16 of the regional law no. 27 (Rules for the protection and management of wildlife and for the discipline of hunting), replacing the board of auditors made up of three members, with a single statutory auditor.
Article 2 replaces paragraph 6 of article 18 of Regional Law 64/1994. The revised text refers to the regional law now in force and introduces a new specific case for hunting dogs.
Article 3 modifies paragraph 1 of article 30 of Regional Law 64/1994 in order to harmonize regional regulations with the relevant state legislation (Law 157/1992), which no longer includes, in the list of huntable species, the crow, the starling and the jackdaw. The Aosta Valley has implemented the state legislation by not including the aforementioned species among those that can be hunted in the hunting calendar. With this bill it was considered appropriate to include this concept also in the legislative text.
Article 4 changes article 33 of Regional Law 64/1994. The revised text, in particular, establishes that the regional card for hunting within the region is prepared and issued by the Regional Committee for hunting management.
Article 5 inserts article 33bis into Regional Law 64/1994. The new article establishes a Disciplinary Commission with the task of expressing an opinion on the prohibition of issuing the regional hunting card, for one or more hunting seasons, against hunters who have committed the violations referred to in Article 33ter of Regional Law 64/1994. , introduced by article 6 of this bill.
Article 6 introduces article 33ter to Regional Law 64/1994. The new article concerns the prohibition of issuing the regional card in the cases listed therein.
Article 7 modifies article 46 of Regional Law 64/1994, relating to penalties, transforming the established amounts from lire into euro and adjusting them to the increase in the cost of living recorded in the meantime.
Article 8 introduces a modification to the transitional provision referred to in the regional law of 12 June 2012, n. 16 (Amendments to regional law no. 27 of 1994 August 64), specifying the procedures for assigning and distributing hunters in the municipal sections pending approval of the new regional wildlife-hunting plan.
DRAFT LAW
Art. 1 (Replacement of article 16 of regional law no. 27 of 1994 August 64)
1. Article 16 of the regional law no. 27
(Rules for the protection and management of wildlife and for the discipline of hunting), is replaced by the following:
"Art. 16 (Statutory auditor)
1. The control over the administrative and accounting management of the Regional Committee for Hunting Management is the responsibility of a statutory auditor, appointed by the Regional Council from among those enrolled in the register of auditors, who remains in office for three years. ".
Art. 2 (Amendment to article 18 of Regional Law 64/1994)
1. Paragraph 6 of Article 18 of Regional Law 64/1994 is replaced by the following:
"6. Failure to keep hunting dogs is sanctioned pursuant to article 31, paragraph 1, letter c), of regional law no. 22 (New provisions for the protection and correct treatment of pets. Abrogation of the regional law April 2010, 37, n. 28). In case of escape of such animals during the hunting exercise, the sanction is applied if the owner or keeper of the hunting dog has not communicated the flight of the animal, within twenty-four hours from the same, to the Municipality of residence or of habitual residence, or at the regional kennel, or at the veterinary services of the USL Company or the Forestry Corps of Valle d'Aosta. ".
Art. 3 (Amendment to article 30 of Regional Law 64/1994)
1. In letter b) of paragraph 1 of article 30 of Regional Law 64/1994, the terms: “crow (Corvus frugileus)”, Council Acts of the Valle d'Aosta Regional Council XIII Legislature - Regional bill no. 226 "starling (Sturnus vulgaris)" and "jackdaw (Corvus monedula)" are suppressed.
Art. 4 (Amendments to article 33 of Regional Law 64/1994)
1. Paragraph 1 of Article 33 of Regional Law 64/1994 is replaced by the following:
"1. Anyone intending to hunt within the region must be in possession of the relevant regional card "Carnet de chasse", prepared and issued by the Regional Committee for Hunting Management. ".
2. Paragraph 7bis of article 33 of Regional Law 64/1994 is repealed.
Art. 5 (Insertion of article 33bis to regional law 64/1994)
1. After article 33 of Regional Law 64/1994 the following is inserted:
"Art. 33bis (Disciplinary Commission)
1. The Disciplinary Commission is set up at the Regional Committee for Hunting Management, with the task of expressing an opinion on the prohibition of issuing the regional card. This Commission is made up of three members, one of whom with the function of President, appointed from among the members of the Committee itself.
2. The Commission is convened by the President, for the sessions to be valid, the presence of all its members is required and decisions are taken by majority vote. An employee of the Regional Committee for Hunting Management performs the functions of secretary. ".
Art. 6 (Insertion of article 33ter to regional law 64/1994)
1. After article 33bis of Regional Law 64/1994, as introduced by article 5, the following is inserted:
"Art. 33ter (Prohibition of issuing the regional card)
1. In cases of definitive conviction for the violations referred to in article 30, paragraph 1, of law no. 11 (Rules for the protection of homeothermic wildlife and for hunting), the President of the Hunting Management Committee, after consulting the Disciplinary Commission, prohibits the issuance of the regional card for a period of up to five years, with effect from the beginning of the hunting year following that in which the procedure was defined; in case of donation or application of a reduced sentence, the prohibition of release cannot exceed three years.
2. In cases of notification of the injunction order for the violations referred to in Article 31, paragraph 1, letters b), c), e), f), g), h), i), l), of the l.157 / 1992 and Article 46, paragraph 1, letter i), of this law, the President of the Hunting Management Committee, after consulting the Disciplinary Commission, prohibits the issuance of the regional card up to three years, with effect from the beginning of the hunting year following the one in which the procedure was defined; in the case of a reduced payment, the prohibition on release cannot exceed two years.
3. In cases of notification of the injunction order for the violations referred to in Article 46, paragraph 1, letters a), c), d), e), f), g), h), l), m ), o), p), q), r), s), the President of the Hunting Management Committee, after consulting the Disciplinary Commission, prohibits the issuance of the regional card up to two years, with effect from the beginning of the hunting year following that in which the procedure was defined; in the case of a reduced payment, the ban on release cannot exceed one year.
4. The periods of prohibition of issuing the regional card referred to in paragraphs 1, 2 and 3, if they are less than a hunting year, must concern periods of actual hunting, with the exclusion of hunting periods for wild boar and hunting. Fox.".
Art. 7 (Amendments to article 46 of Regional Law 64/1994)
1. In letter a) of paragraph 1 of article 46 of Regional Law 64/1994, the words: “from 200.000 to 1.200.000 lire”; if the offense is committed within protected areas: from Lire 300.000 to Lire 1.800.000 "are replaced by the following: "From € 160 to € 960; if the offense is committed within protected areas, from € 240 to € 1.440 ".
2. In letters b), g), n) and r) of paragraph 1 of article 46 of Regional Law 64/1994, the words: "from 50.000 to 300.000 lire" are replaced by the following: "from 40 to 240 euro ".
3. In letters c), e) and o) of paragraph 1 of article 46 of regional law 64/1994, the words: "from 500.000 to 3.000.000 lire" are replaced by the following: "from 400 to 2.400 euros ".
4. In letters d), q) and s) of paragraph 1 of article 46 of Regional Law 64/1994, the words: "from 100.000 to 600.000 lire" are replaced by the following: "from 80 to 480 euros".
5. 1. In paragraph 1 of article 12 of the regional law no. 12 (Amendments to regional law no.2012 of 16 August 27 (Rules for the protection and management of wild fauna and for the discipline of hunting)), the following period is added at the end:
"If the number of hunters already registered is such as to compromise the management of huntable species compatible with the demographic dynamics aimed at increasing game or does not allow to ensure an average per capita quota of animals that can be taken and assigned homogeneous in all hunting districts, the Regional Committee for Hunting Management, pending approval of the Regional Wildlife-Hunting Plan, can automatically assign all or part of the supernumerary hunters to the other municipal sections, according to criteria established by the Committee itself and approved by the competent regional structure. of wildlife.
