Il Regional Administrative Court of Campobasso has ruled on the possession of weapons and their transfer. In particular, the judges upheld the appeal of an engineer who found himself in a particular situation. According to the TAR, possession also presupposes a report within 72 hours subsequent to material availability. In case of transfer from one Italian location to another, the complaint must be repeated.
The man, fond of hunting, guarded three guns in the mother's house, moving them to a country residence and keeping them in a closed drawer. Two days after the move, however, a theft had occurred with the consequent contestation of negligent non-custody. According to what was established by the Court, the man should have reported the transfer of the weapons to the new home within 72 hours, but since the theft took place before this deadline, there was just no material time to provide.
This is why the appeal was accepted, without contesting the omission: among other things, the judges also took into account the maturity of the engineer and theabsence of weapon abuse. In other words, the prohibition of possession of weapons, the order to transfer them to an armory and the revocation and precautionary withdrawal of the shotgun port for hunting use they appeared disproportionate to what had been considered a violation.
